Svalk Terms of Use ================== Effective date: 30 September 2026 These terms are an agreement between you and Skretteberg AS (org.nr. 937 577 648) ("we", "us"), the developer of Svalk ("the app"). By downloading or using the app you accept them. If you do not accept them, please do not use the app. 1. What Svalk does ------------------ Svalk is an app for outdoor bathing, winter and summer: water temperatures at bathing spots, a log of your dips, a season plan and a safety check-in with a buddy. You need an iPhone and an internet connection to use it. 2. Water temperatures are estimates ----------------------------------- Water temperatures come from MET Norway's ocean model and are estimates, not measurements. The real temperature at your spot can differ, especially near the shore, in rivers and in inner fjords. A reading you add yourself shows instead of the estimate for a few hours. Cold water is dangerous: judge the conditions yourself, know your limits and never rely on the app alone. 3. The safety check-in is not an emergency service -------------------------------------------------- The check-in sends your buddy one text message if you do not check out before the deadline. It depends on your phone, the internet, our servers and the mobile network, and a message can be late or not arrive. It does not contact the emergency services, and it does not replace bathing with someone or telling people where you are. In an emergency, call 113 (Norway) or 112. Only add a buddy who has agreed to it. The app warns you 2 minutes before and at the deadline; the text is sent 3 minutes after the deadline if you have not checked out. To limit misuse and cost, check-ins are limited per day and alerts per month. 4. Who can use Svalk -------------------- You must be at least 16 years old. Your account starts anonymous. You can link it to Sign in with Apple to restore it on a new phone. You can delete your account at any time in Settings → Delete account. 5. Subscriptions, free trial and billing ---------------------------------------- • Free use: without a subscription you get the water temperature at your home spot, the dip log, your streak and Apple Health. • Svalk+ adds more spots, the safety check-in, season stats and your full dip log. It is an auto-renewable subscription with yearly, monthly and weekly plans. The price, the billing period and any trial are shown in the app and on Apple's payment sheet before you buy, in the currency of your App Store country. • Free trial: some plans include a 7-day free trial for eligible new subscribers. Apple gives one introductory offer per Apple Account in the subscription group. If you do not cancel at least 24 hours before the trial ends, the subscription starts and you are charged the plan price. • Payment: payment is charged to your Apple Account when you confirm the purchase, or when the free trial ends. • Automatic renewal: the subscription renews automatically for the same period unless you cancel it at least 24 hours before the current period ends. Your account is charged for the renewal within the 24 hours before the period ends. • Special offers: a discounted plan renews at the price shown when you bought it, unless the offer says otherwise. • Cancel or manage: go to Settings → your name → Subscriptions on your iPhone, or your App Store account settings. Deleting the app or your Svalk account does not cancel the subscription. • Billing problems: if a renewal payment fails, Apple may retry it for a limited time and you keep access during that grace period. • Refunds: Apple handles payments and refunds under its own rules (reportaproblem.apple.com). • Fair use: to prevent abuse, the number of check-ins you can start per day is limited. 6. Acceptable use ----------------- Please do not: • add someone as a buddy without their permission, or use the check-in to send messages to people who did not agree to it; • send automated requests, scrape the service or reverse-engineer the app; • interfere with the app, the servers or other users. We may suspend access if these rules are broken. Group names and display names must not be offensive, impersonate others or contain personal information about others. We may rename or remove a group, or remove a member, after a report. 7. Our rights ------------- The app, the Svalk name, the mascot, the design and the content belong to us or our licensors. These terms give you a personal, non-exclusive, non-transferable right to use the app for your own, non-commercial purposes. 8. Apple -------- These terms are between you and us, not Apple. Apple is not responsible for the app or its content and has no duty to provide support for it. Your use of the app is also governed by Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). If the two conflict, Apple's agreement prevails for the license to use the app. 9. Disclaimer and liability --------------------------- The app is provided "as is" and "as available". We work to keep it accurate and running, but we do not promise that it is error-free or always available. To the extent the law allows, we are not liable for indirect or consequential losses. Nothing in these terms limits liability that cannot be limited by law, or your mandatory rights as a consumer. 10. Changes ----------- We may update the app and these terms. If a change is important, we will tell you in the app. If you keep using the app after a change, the new terms apply. 11. Governing law ----------------- These terms are governed by the laws of Norway. If you are a consumer living elsewhere, you keep the mandatory protections and the right to go to court that your country's law gives you. 12.
